Well said; and Merc14, I have to agree with Jugo in that the command principle was in place at Nuremberg (and afterwards in the Int'l Crim. Court in the Hague; google "Bosnian War Crimes Trials). Bush, Cheney and Rumsfeld were as much war criminals as were Tojo, Adolf, Stalin, etc., and Nixon and Kissinger also deserved consideration. The late Augusto Pinochet died before arrest and trial, and although the people of Kosovo erected a statue in honor of him, the Serbs consider Clinton a candidate, too. One person's liberator is another's fascist.
I've had no patience with Nazis since I was a little boy listening to my father's WWII stories; when I learned they incinerated 9/10's of my father-in-law's family, I realized their cowardly actions and vapid ideology were sheer dreck and not worthy of comment. If they're not rotting in hell, I believe they should be.
Coincidentally I'm reading some historical fiction at present regarding the collusion between Nazi Germany and free Finland, beseiged by the Soviets, during WWII. The fictive Finn in the novel happens to be 90 years old, too. Much of the narrative is about escaping the evil deeds of one's past, establishing oneself in a new, peaceful life and the chances of evading retribution, vengeance or even justice forever. It's a very interesting parallel to the current "real story." I'll let you know how the author works it out.
Some posts here leave the real SS man's fate in God's hands ("Vengeance is mine, I will repay," says the Lord--Romans 12:19, NRSV); others say the alleged culprit is too advanced in years for any effective prosecution to be meaningful. I believe--and it is belief alone--that we must do all we can on earth to bring about any semblance of justice we can. You can run, but you cannot hide. Otherwise evil is ceaselessly mitigated by a myriad of explanations, excuses and excesses of time. After death, leave the finality issue to scriptural, theological, philosophical, spiritual or personal principles--but remember the victims.
