Does anyone know if WINMX is legal? Is is legal to share music files or is
this copyright infringement?

I wouldn't dare to say I'm exactly 100% right but,I think it is. sad.gif
I couldn't find the installer file right now in download.com,I think they've deleted it already......and that's the end of my road with WinMX sad.gif .Are you still using it joc??Is it still active??

I just downloaded it right before Christmas. I am still using it as early as last night. So yes it is still active...but is it legal?

I view it no differently than giving you a CD. It isn't copyright violation for me to share my CDs with you. So what is the dif?

Sorry to tell you this joc but sharing or swapping of any copywritten material is illegal no matter what program or site you use.
WinMX has so far been flying under the radar but not for long I would think.

WinMX, Kazaa, Napster etc are not illegal in themselves because they are for FILE sharing, not specifically MUSIC FILE sharing but it is illegal as someone has mentioned to share/copy/download/upload copywrighted music and Film media. The FBI/IRS in the US and CID/IR in the UK have actively started prosecuting USERS not the filesharing program companies. In short it's started to get quite dodgy but lets face it, how many of the 49 million users of Kazaa can the FBI prosecute?!?

Well, personally for me, it isn't about whether or not I will get caught. It is about whether or not it is illegal. If it is illegal then I don't want to do it. Not because I might get caught....rather simply because I want to do what is right. And conversely, not do what is wrong.

Didn't I hear something about $500,000 dollars per song? Well once you've downloaded one song you're already f#cked, so you might as well carry on and download another 3,000. grin2.gif

get a few movies while your at it and some programs and some games and whatever you feel like at the time because we're all f***ed if you get fined that much.


I have a good defense if i get caught but i'll save that for myself.

I THINK YOU FAILED TO SEE THE POINT THAT JIMMA WAS MAKING
the program itself is not illegal i.e it's not illegal to share files..such as your personnel music/photos or home movies

but to share music/photos or movies that have a copyright on them is illegal.

but then have we not been on this topic before....file sharing is illegal.... laugh.gif

anyway i think the only person braking th law is the person who converts the song from the original cd to mp3

joe bloggs records a song and in it ,the drummer blows a dog whistle 3 times
the song is recorded and made into cd's
jimmy buys the original cd...(joe bloggs and the dogs)
he plays it at home where ROVER the DOG goes nuts when he here's the 3 dog whistles
jimmy converts it to mp3 on his pc and posts it on a peer to peer/share network
jimmy's mate jonny downloads it,as an mp3,,and burns it onto a cd
he then plays his cd with the mp3 version of (joe bloggs and the dogs)
to jimmy and rover

rover does not react,,why

because anything below or above the human hearing is taken out when it's converted to mp3..that is why mp3's are smaller in file size...but

and here is the point....(joe bloggs and the dogs)cd
and (joe bloggs and the dogs)mp3
are not the same piece of music
therefore the only person breaking the law is jimmy as he has changed it
jonny on the other hand has downloaded a different peice of music


and i know not everyone has dog whistles in the recording but...if every original song is less in file size than the mp3 version ,then there are some sounds outwith our hearing that have been takien out ,therefore they are not the same thumbsup.gif

I posted the question because I wanted to know if file sharing of
copyrighted music is illegal. I think the answer is that it is. But your
assessment of the issue is somewhat confusing and I believe...inaccurate.

I am pretty sure it is not illegal to copy a CD as an mp3 file.

But it seems that it is illegal to download someone elses copy.

Unfortunately it is not legal to make copies of any copywritten material. Music, Software or otherwise.
When you buy a Cd you are only paying for the right to have the original copy you bought and being able to listen to that copy. It does not give you the right to make more copies or to play to the public.
Copying to MP3, WAV or any other format is still classed as copying and therefore is also illegal wether the quallity is inferior or not.
With copywrite laws now even if you record a riff that was used by Jimmy Page for example it does not have to be identical to the original. Even if you change the key you play it in it is still copywrite infringment.
I don't agree with these laws at all and as a muso myself I think the loss of these music sharing programs has meant a big loss to me being able to get my music heard. Unfortunately that's just how it is and untill we all stand together and stop buying CD's the money grabbers are going to get away with this.

Just to let you know you only get in trouble on kazaa if you have file sharing enabled . If you go download kazaa lite user K++ you can turn off file sharing of your files so no one can download from you and you can from them . Then check the option *users cant get list of my files* and your pretty much free to do as you wish , their are too many people on kazaa so the governments are only targeting those who are distributing the files . So if your going to download go do it while people still have the guts to have file sharing kept on .
