Full Version: Woman files lawsuit against AMR

A 21-year-old Harris County woman filed a $200,000 lawsuit against American Airlines alleging employees on a flight to Los Angeles from Dallas/Fort Worth Airport failed to protect her while she slept from another passenger who masturbated to her and ejaculated in her hair, according to a lawsuit she filed last week in Tarrant County.

The Harris County woman alleges employees knew of the risks associated with failing to "police the passengers to ensure that passengers do not hurt one another," the suit states.
Airline officials did not return calls seeking comment. In a statement to a Houston television station last year, a spokesman said the company regretted the incident, but the flight crew took appropriate action.

The woman and her lawyer could not be reached for comment. The Star-Telegram does not identify victims of sexual crimes.

Destined for a Spring Break visit with family and friends March 19, the woman flew from Houston to DFW Airport and had settled into her seat for the last leg of flight 2074 to Los Angeles about 11 p.m., the suit states. The woman slept most of the flight, but awoke about 20 minutes before landing when the pilot announced the plane was on descent into Los Angeles. When the woman opened her eyes, she saw that an unknown man had moved into the seat next to her and was staring at her as he masturbated, the suit states.

The woman turned toward the window in embarrassment and in an act of nervousness began to run her fingers through her hair where she noticed "a substantial amount of an extremely sticky substance in her hair," the suit states.

The woman began to cry and tried to get the attention of a flight attendant, but was unsuccessful, the suit states. Finally a passenger in the row in front of the woman comforted her and verified the semen in her hair, the suit states.

When the plane landed, employee called airport police and the man was arrested.
The suit alleges that the during the investigation, American Airlines employees told police they witnessed the man move from his assigned seat into the row where the woman was sleeping.
The woman is seeking punitive damages and a jury trial.

I can't understand why in crimes like these and other people on board the plane would turn a blind eye as a young woman is assaulted?

I do, too, really. Not to be graphic, bit isn't that something other people would notice and make violent objection to? And the mechanics of it seems odd to me, too: he was /beside/ her?

Very good point.
If she was upright in her seat (cause really, how far back do those seats lay? A whole 4 inches? rolleyes.gif cheap airlines.... *grumble, grumble* happy.gif ), the guy would have had to be a good aim *cough*, or he would have had to be standing up, to get it in her hair; and I think a guy standing while masturbating would definitely draw some attention.
I personally think this was a hookup gone bad - she regretted it right after, or the guy pissed her off, and she not only gets the guy to go to jail for it, she figured she could make a quick buck off the airline while she was at it.
I know I probably sound harsh; and trust me, as a woman, I take sexual assault very seriously. If this ends up being proven true, I'll eat my words. But the story as it is right now doesn't seem right to me....

The how isn't too difficult to figure out, it's the where the heck was everyone else while this was going on?
And yes this does have to be proven.

Nobody; the man himself isn't being sued or prosecuted. It's the airline.

The man was jailed. I assume he will be facing charges. Other posters think this is a possible scam. I cannot fathom being involved in a scam where I will be jailed and labeled just to cash in on some lawsuit money.

He moved into the seat next to her, which means that seat was empty; she she was likely partially laying down, maybe pillows on the armrest.

that's digusting... really. but, it could well have been difficult for anyone but the folks in the seats right across the aisle from her to see what was going on. The seat backs on AA planes are very high. If he had his back turned to the seats across the aisle, they might not have even noticed, or, they were asleep themselves.

I would'a done the cops a favor and ripped the guys arm/hand off that he was using and beaten him to death with it, that way they could just call it a domestic disturbance and be done with it. Either way, I hope he gets violated by a freight train when he gets locked up.

Well you would have to go "over" the guy to get into the aisle since your in a window seat.

Why not just bust him over the head for waking you up? I think ruining someones sleep is worth a few days in jail, the whole masturbation thing should just add to the sentence.

Actually, many years ago I had someone in the little coffee shop I worked in that was sitting at a table all day, ummm, well... you know. I was so stunned when I saw it, I couldn't do anything. Eventually, a family came into the shop, I took their order, went and got their coffee and deserts, then on purpose dropped the tray hoping he'd get up an leave. When he didn't, I apologized to the family, and told them I was going to get a mop, then ran in the backroom and called police. He must have figured out I called, because he was gone by the time they got there.

Until you're in the situation, you really don't know what you'll do. I was surprised by my own reaction. You just don't know, especially when you've just experienced somthing so violating and honestly profoundly embarassing.

Exactly!! I had a similar experience working at a fast food chain. You don't know what the heck to do at first...especially if you have been trained since birth to be quiet and not make a fuss in public.

If I can quote what I said in my earlier post, IF this is a scam, I don't think the guy is involved:

But again, like I also said in my first post, I could be wrong. From what I'm reading now, something doesn't seem right, like the story doesn't jive.

There's so many theories, and all are possible no doubt! But it's still a sick, disgusting thing to do, and see! And i have to wonder where the flight attendants were while this was going on? Arn't they walking around checking to make sure passengers are comfortable, and have what they need etc...? I've never flown, but i would imagine they are the ones who are supposed to keeping an eye out for all sorts of things at all times, or am i wrong and they just have a yak session in the back till a call button goes off from some passenger who wants something? hmm.gif

He was arrested and I'm guessing the DA will bring several charges against him. Indecent exposure, battery, lude conduct, public nudity among other crimes. He then, if there are witnesses and DNA, will be a co-defendent in any civil trial. The airlines could be found quilty of negligence with punitive damages.

I doubt this is a scam, but further investigation is warranted; question all the people sitting in that row, and the adjoining rows, airline employees...list goes on.

It was some 20 or less minutes before landing... the flight attendants at that point are going through their pre-landing safety and landing routines which is fairly involved. They're paying less attention to the passengers at that point getting ready to get the bird on the ground safely.

I have thousands of hours in the air, and honestly, I can see how this could happen without anyone noticing. It's totally gross and unfortunate, but I don't think this young lady will win her case, but you never know in this country's courts.

I really cant see how it could happen not by the thought some one should have noticed but the fact it got in her hair?

the distance needed to pull that off with out getting you're self or some one in the front seat or back seat is.... impressive lol for lack of a better word.

Ok...

1. There was no one in the seat(s) next to her

2. She was sleeping, and likely partially laying down in the empty seat, I'm going to guess with a pillow on the arm rest, perhaps even on the empty seat itself.

3. Seat backs on AA planes are VERY high backed, sitting straight up and down, my own head is a good 4" below the seat back height. You can't see the people in front or back of you.

4. The clearance between your seat the ones in front of you in coach is really small. No more than 2ft, if that.

5. It was just before landing, flight attendents were overseeing pre-landing routines.

6. if my scenario is correct, all this perv had to do was slide into her row with his back to aisle (perhaps parially sitting on the aisle arm rest?) and his body would have shielded anyone in the aisle or across the aisle from seeing in to that row. At which point, he could have done his business with no one seeing it at all. People in the aisle wouldn't even have been able to see over him either due to the positioning of the overhead bins.

I guess having spent thousands of hours in cattle coach in my lifetime, I can see how this could happen... it's not impossible. There were times I had flights with weirdos sitting next to me where I thought to myself, "I better not fall asleep, becase I don't trust the psycho in the seat next to me"...

I do think she was assaulted, I don't think she'll win against AA though unless those lawyers can weave a good case for AA's seat designs and overhead bin designs as unsafe. Of course, the FAA has regulations on how seats have to be built for safety reasons.
