I have no idea what you are talking about concerning Top Secret clearances and getting people's rights heard.
Incidentaly, Top Secret clearance does
not mean you get to peruse through anything you wish at that level. It means you can get access to thing of which you have a clear Need-To-Know, nothing more. You try barging into a Top Secret site without going through proper channels, and you will take a quick tript to the brig, quite likely followed by a loss of your security clearance, as you have shown yourself to be a risk.

Well, that's just it, isn'it? It doesn't concern "the people's" interests and rights. The military is set up as a completely seperate entity from the civilian world for a specific reason. The military does not get tried in civilian courts, they do not get involved in civilian affairs, and they do not answer to civilian desires. The military has one job, and one job alone, and that is to protect the security and interest of the United States (as in country, not people). So, in answer to your question, they neither have to justify themselves, nor is it anyone's "right" to know. The legal system is set up this way so that they can concentrate on defense without having to field generations of conspiracy theorists, alien devotees, and peacemongers at the gates.
