FAIRVIEW, Tenn. - After nine years of c***-a-doodle-do, a judge is being asked to rule c***-a-doodle-don't. Richard Milardo has filed a civil warrant against his neighbors, Jon Jackson and Kimberly Roberts, seeking to force them to get rid of four crowing roosters.

"I've heard enough," Milardo said. "I shouldn't have to listen to this anymore."

Milardo said the hens, turkeys, donkeys, geese, swans and dogs Jackson and Roberts keep on their 2 acres of land don't bother him. But the roosters have him at wits' end.

Milardo and his neighbors live beyond the Fairview city limits, where there is no noise law and animal control officers say they are powerless to provide peace from poultry.

"I like to hear them crow," Roberts said. "They don't bother anyone else but Richard."

She acknowledges, though, that her roosters have a lot to say.

"They crow in the morning, they crow when the sun is going down, they crow when their girlfriends are laying eggs," she said.

Milardo said he moved to his home, about 23 miles southwest of Nashville, in 1992 to escape noise. Jackson and Roberts moved next door — more than 100 yards away — a year later. The roosters took up residence about nine years ago.

"I just want to hear the creek and the wind and the songbirds," Milardo said. "I would like the roosters to go and they can keep the rest of the animals behind the house."

The case is set for Monday in Williamson County General Sessions Court.

Why did he wait all this time to file the suit? Its the country... there are bound to be animals that will make noise. Its also a farm so what can he really do?

so wait.... the guy moved in like when there was a "farmish" place right next door?? what did he expect... if that is the case.. i dont think the roosters owner should have to chnage anything.. the guy chose to live there..... now if the farmish guy moved in next to the complaining guy then maybe he has a right to complain but if not he should shut up and move somewhere else....
