DENVER (Reuters) - A judge overturned a convicted murderer's death sentence because jurors consulted Biblical passages such as an "eye for an eye" during death-penalty deliberations.
Robert Harlan was convicted and sentenced to death in 1995 for the murder of Rhonda Maloney, a waitress who was driving home from work when Harlan forced her car off the road. Harlan also shot and paralyzed good Samaritan Jaquie Creazzo who tried to come to the woman's aid.

That's a really odd one because they make you put your hand on the Bible and swear to tell the truth. Could that negate perjury on the grounds that the bible shouldn't be used in court related matters. And what about when the judge sentences someone to death, I believe he/she adds "and may God have mercy on your soul" enter the sticky ol seperation of church and state thingy rule again, hmmmm curiouser and curiouser it gets

a point i was disscusing in the house...if a witness is made to swear on the bible to tell the truth..blah blah blah... then the jury would asume they are telling the truth because they swore on the bible...
but if they refused to swear on the bible because they did not believe in the bible or god...would the jury believe what they are saying
or even more of a point would they be allowed to take the stand..or be charged with contempt of court,,,,,,

I think the witnesses should swear on a leprechaun. Then the jury can take the leprechaun in the back and consult it for inspiration. Than at the end they can all share a pot of gold and eat lucky charms. Their magically delicious.....and colorful.
(P.S. go to the store, by a box of lucky charms if you don't have one...then get a black marker. On Lucky....draw some evil eye brows...like----> \ /
you'll notice that the expression on his face looks strikingly evil with only the addition of the eyebrows. It looks like he's saying "go on! eat my cereal...it's poison I tell you! Poison!!!!)....If you have the time to try this...please do it, it's hilarious!)

even though, I may look like even more of a loser...the trick also works with "Trix", "Cap,n Crunch" and all three of the "Rice Krispies" gang. But I warn you....don't do it too all of the cereal characters at once....when they come out of the boxes to get you it may be too much to handle.
P.s. Fred and barney from the "Pebbles" cereals are pending. Also the people on the "Kashi" boxes might be an interesting experiment...as well as any kid who happens to be on the "LIFE" box at any current moment in time.

why bigsteff, if some one does not believe in the bible, they should not be said to tell the truth, they should swear on something they hold sacred not the state.( if this sounds funny, donot be alarmed, as i am drunk and agrivated that they did not let me into the club.0

Why do you never hear of anyone having to swear on the Koran, or the Torah, etc?
Some courts do stop short, using just "Do you swear to tell the truth, the whole truth, and nothing but the truth?" Sometimes they throw in "...so help you" for good measure.

To make this a legall issue could be setting a dangerouse precedent . It would open a loop hole big enough to let most of our prisoners back out and on to the streets.

LOok in the bible it says not to take any oath by God or the heavens,
and that includes the bible
if you dont know why,then you should not comment on this BUT it means that a oath under the court system is bullshit to God anyway becouse of this reason

I don't know about any other country, But here in america only the innocent need to worry about the bible in court. This country has never had a perfect judicial system as much as we would like to thing so.
THe fact that they used to sentence him to death should be overturned IF it was the only thing they used to decide his punishment.

Good 1,but you must understand,we are not aloud to make oaths under God or any thing in heaven,its a sin.
So does anything said in court matter to God,This is why to man it matters

I have found that almost any "religion" can use certain text to justify the means to an end.
What I found interesting is your comment about not swearing anything by god's name. Your right. In a sense they (the powers that be) are asking you to violate the very oath thier asking you to swear to.
Another interesting point is that they claimed the "bible" was used, and forgot to mention that it was jewish law, not christian teachings that were used in the condemming of the prisoner.

You'd prob. be held in contempt of court. I find the judicial system lacks any sense of humor. (Except when it comes to the rich and famous)
