BONITA SPRINGS, Fla. - After a girl got sick in the bathroom of her kindergarten class, the teacher made her don rubber gloves and manually remove a clog from the toilet, according to a lawsuit filed by the girl's mother.



Lori Januska sued Bonita Springs Charter School this week after she said her 5-year-old daughter, Heather, clogged the toilet Sept. 22 and her teacher made her remove the clog as the entire class watched.


The suit said "a vulnerable 5-year-old was subjected to cruel, unusual and traumatic disciplinary actions which directly resulted in severe emotional distress, pain and suffering and mental distress." The girl suffers from an incurable gastrointestinal condition.


The suit, which seeks unspecified damages, claims the school staff was negligent in hiring an unqualified teacher.


School principal Pamela Franco and school district attorney Keith Martin declined comment on the suit.


Mark Levinsen, senior vice president of administration and human resources for Charter Schools USA, investigated the original complaint and said the teacher was disciplined.

The teacher has been spoken to and that should be the end of it,the bit about the kid being distresed etc makes me giggle, a bloody 5 year old,i think here parents are out to get as much as they can while useing the 5 year old as the pawn,how much stress are the parents going to put her through to get some cash the greedy bee`s . they are actring worse than the teacher

I don't know if the child was distressed or not, but the teacher had no right in making the child unblock the loo.

hehe sometimes it works. My boss told me once that I couldn't take a passenger out to one of our gas fields and ever since that one time I haven't.

I made my 5 yr. old clean up his messes like that. Well, I'd help him and guide him... he's 6 now and I still have to stand there and do half of whatever clean up he does (tracing the toilet seat with urine a few weeks ago laughing his head off)... he's still learning... making a spectical out of it though was a bad move on the teacher's part no matter how you slice it...

I don't know of any 5 yr. olds that intentionally throw up hehe... talking about the "teacher" not that poor kid...

And then I go on rambling about it's not bad to make the kid clean it up (with supervision, just like any mess they make) but making a specticle out of it was a dumb move.

The poor girl didn't do it on purpose. I've cleaned up many a mess from my two boys when they've gotten sick. I wouldn't expect them to clean up an accident. Now if they had done it intentionally thats a different story.

I agree that the teachers had no right, but in modern societey evreyones just out to line their own pockets rather than make things better.

Take the recent case of a woman who sued a bank after one of the men who worked there called her old and ugly.

She sued for 15.6 million under gender discrimination claims.

She won.

Rather than give the money to the company to hire better employees or donate it to an anti-sexism societey....

...she now lives in a mansion with four cars drinking champagne and swimming in a luxary pool.

Well, there are some cases in which someone that has some type of gastrointestinal illness... that if they intake dairy, it can actually come back as almost a solid. That might explain why the toilet was blocked. That or, maybe another child could have done something previously. I honestly doubt that a five year old who is about to be sick would clog up a toilet intentionally. Yeah, that was just wrong what that teacher did.

i remember when i was a kid (and we had to walk to school in the snow for FIVE kilometres....lol) we had to ask to go to the toilet... now thats shizen

That is a bit of an extreme measure, it's one thing to ask a child to mop up after themself, but to make a that poor kid fish around in a toilet to unclog it is really disturbing. The kid just got sick, it happens, send her to the nurse and let the janitor take care of the dirty work.

It was an accident. It's not like the kid said 'Oh, hey, I think I'm going to go throw up just for fun!' At least the kid made it to the toilet and didn't throw up all over the freakin' teacher!

That teacher should have never done this! She needs her head shoved down a toilet repeatedly.

If I ever have kids, which I seriously doubt, and they come home and tell me something like this, I won't be taking anyone to court. They will be taking me to court and jail after I beat the **** out of the teacher. angry.gif

It would be a completely different story if the kid done it on purpose, but you can't control throwing up. I seriously doubt the little girl stuck her finger down her throat. disgust.gif

I don't think anyone said that she did it on purpose. We are saying that it would be a different story if the girl did do it on purpose...but we doubt she did.
