No I am not certain where or when this happened, but I remember reading about in the news.

A man was fired from his job for testing positive for marijuana use. The man sued the company citing that the marijuana was not illegal in the country in which he used therefore he was not in violation of any company rules, federal or state laws. The man provided proof of a vacation to amsterdam, and receipts from a hash bar which he openly admitted to patronizing. His lawyer stated that while in foreign countries we are subject to their laws, as in the case of Michael Fey who was caned in singapore in the early 90's. Since the Marijuana was used in a country where it is not illegal, the man was not in breach of his work contract which stated that he would be tested for illegal substances and fired in the event of a positive urinalysis. Nor did the man break any federal or state laws. To my understanding the man won his case, three years salary, compensation for the amount of time lost after being fired and all court/lawyer fees.

I'm glad he won his case.... it's not like he was stoned at work....

Quite true; marijuana will test positive for up to 12 weeks after partaking. As far as I'm currently aware there is no test that shows you've smoked it today rather than 2 weeks ago.

I don't see anything wrong with him. That company though... is just stupid.

If he was an athelete he would have been banned because it was in his system, regardless of where he used the substance.
This would also be true of many large companies, they will put a clause in there contract of employment.
If they can smoke it in another country, they are likely to smoke it anywhere?

long as you don't go to work while on a substance, it should be fine. And as far as my country, I wish we'd legalize it already.

What are the arguments for keeping it illegal? I've never heard any good ones.

Very true. If it was legalised the government would be able to tax it and generate more money. The same goes for cigarettes; if they banned them from sale they'd lose so much money, that's why I don't think they're too worried about everyone giving up... (sorry, I'm a cynic LOL)
