ALAMOGORDO, N.M. — A New Mexico jury found a 16-year-old boy guilty of two murder counts and one count of voluntary manslaughter Tuesday for the shooting deaths of his parents and stepsister on a ranch owned by newsman Sam Donaldson.

Cody Posey was convicted of first-degree murder for the death of stepsister Marilea, who was 13 when Cody shot her twice in the head in July 2004, after deciding his world would "be better off" without his family.

He was convicted of second-degree murder for killing his stepmother, Tryone.

The jury found him guilty of a lesser count, voluntary manslaughter, for killing his father, Paul Posey, who Cody claimed abused him physically and emotionally from the time he was a baby up until minutes before the shootings.

I agree completely with the convictions. The father was not abusing him at the time he killed him, so voluntary manslaughter fights. The murder of his step sister seems like a senseless murder, unless she was being abused by the father as well and Cody killed her to put her out of her misery.

There's just more and more stories like this every single day. Horrible.

yeah i was in bed when i heard it on court tv its pretty crazy, but yeah the wierd thing about it, was that the 14 year old kid was playing basketball down the street, afterwards he went back to the crime scene. The cops asked him questions and he told his confession.

QUOTE
After weighing his options, Cody said he went to the barn to retrieve his sister's .38-caliber revolver, emptied it of snake shot and reloaded it with live rounds.

He went outside with the intent of coming back in and blowing holes in his family, instead of running away to the police or a neighbors house.

QUOTE
He then drove his father's truck into town, bought a can of Sprite and stayed with friends.

Clearly, right there he could have gotten away and he already had a place to stay just in case. But nope, he had to go ahead and kill them.

QUOTE
Cody's defense lawyer, Gary Mitchell, who became emotional at several times during the trial when speaking of the ordeals he believed Cody had endured, said the teen was unprepared for the verdict

Odd. huh.gif Perhaps he was just doing his job trying to win the case but I hope he didn't forget that Cody had a state of mine to weigh his options, go outside, get and load the gun, walk back in and face his family, pointing and shooting them in cold blood, then dragging their bodies through the house, outside into a shallow grave he dug.

Glad to see this kid locked up. thumbsup.gif

If he was going to murder his parents and sister and law, go to his friends and hang out, he sholund'nt of went back to the barn that was so stupid, unless he left the gun at the barn with his fingerprints left on it.

Reading that article, it sounds like there were many people who would've supported him if he decided to go to Social Services to report the abuse, run away or try any of the many, many options he had instead of killing his family.

It also sounds like a lot of people knew about the abuse, at least knew enough about it to testify on his behalf. Wouldn't if have been better for them to do something before it came to this?

Obviously I was the only one who watched the entire trial of New Mexico vs. Cody Posey. During the trial he many people talked about how he went to his mother more than once to talk about the abuse that his father was giving him, who then went to CPS and nothing ever came about it except for more beatings. When his father would find out that his son told on him, he was beat more and more. It seems to me that this boy tried to do everything the leagal way but when nothing seemed to work he got deperate. I hate the way that young people see one little blog on t.v. and they think they have the whole thing figured out. Put yourself in Cody's shoes, imagine a lifetime of beatings from your father who tells you day after day that he doesn't love you and threatens you life, your mother dies in your arms at the age of eight from a car crash, your step mother withholds food from you, your father makes you shoot your puppy in the head at the age of 9, and the straw that broke the camels back was the night before the murder when the father heated up a metal rod and told the boy that if he didn't have SEX WITH HIS STEP MOM he was going to beat him with this burning hot rod. The burning hot rod was proven to be true because when the boy was picked up he had burn marks on his back and neck. There were many other instances when there were witnesses to say what kind of beatings Cody got. So many infact that I would be here all day listing all the things that this family did to him. Everyone, it seemed, that had ever been to this familys house was on Cody's side. Even the father of the little girl that Cody killed took up for Cody, that says alot. The thing that really pissed me off was the lack of interfearance of the friends and family when they saw Cody getting beaten all the time and did nothing. When I watched this trial I just wanted to jump through the t.v. and give this boy a hug. When Cody was on the stand the whole time he was just so polite and said "yes maam" and "no maam" and just looked like a shy little beaten puppy dog. Many of the witnesses said that when you would look at Cody around his father it looked like a puppy dog who had been beaten it's entire life, just shaken up and quiet in a corner. There are just too many things about this case that stuck out in my mind that I cannot list all of them. One time Cody was asked if he had any good childhood memories and he said yes I lived with my mom for 3 months before she died and that was the best 3 months of my entire life because I wasn't beaten, they were nice to me and I knew she loved me. Hopefully now some of you have a new opinion of Cody Posey.

I'm not condoning actions Cody's actions, but I do understand his feelings some. This is a completely screwed up family. wacko.gif Does anyone know if the sister ever went to CPS, police or any other authorities? Maybe the case would have been different if the 2 of them reported the abuse. Also if the neighbors would have spoke up as well. I'm sorry people but if you know about abuse & fail to report it, don't wring your hands about it afterwards. DO SOMETHING NOW!!! TOMORROW MAY BE TOO LATE!!! yes.gif

What I do know...there is a special place in Hell for abusers like this! devil.gif
