Supreme Court ruling OKs government retaliation against whistleblowers

by James Vicini, Reuters News Agency

May 30, 2006

WASHINGTON DC -- A closely divided U.S. Supreme Court ruled on Tuesday that government whistle-blowers are not protected by free-speech rights when they face employer discipline for trying to expose possible misconduct at work.

By a 5-4 vote, the high court ruled against a California prosecutor who said he was demoted, denied a promotion and transferred for trying to expose a lie by a county sheriff's deputy in a search-warrant affidavit.

I advise all to go to that link and read what is written.

This is how we loose our rights, freedoms, democracy and much more. Boiling the frog slowly.

I find this ironic. How can we put up with this? (We have been dsiabled from cooperation by education and media over 2 generations.)

"When public employees made statement pursuant to their official duties, the employees are not speaking as citizens for First Amendment purposes, and the Constitution does not insulate their communications from employer discipline," he wrote.

In 1999 I found a law dictionary in the local law library. The was a definition of "Official Discretion" as "Always rightful and lawful" was written down for all. Naively I used this information in a public comment to the Santa Barbara County board of supervisors. A year later I returned and that dictionary was gone.

RELATION:

The quoted decision tries to turn white into black by implying that the whistleblower was doing anything other than his official duty, defined activities (which must be supported by superiors) benefitting the public, by attempting to correct the erroneous conduct of other officials. The entire purpose of the concept, "always rightful and lawful" says that official duty exists for the people as does free speech which the employees should rightfully be able to use to protect the rights of the people from eventual compromise by erroneous official action.

Major blow to America

How can this be spun to make it appear that this decision is the American citizens best interests? What will the government apologists say to this?

It's obvious power corrupts from the top down.

I'm speechless. huh.gif
