Highlands, N.C. -- An elderly woman who broke her hip when she fell into an open grave as she tried to place flowers on a friend's casket is suing the town and the funeral home.

Marian May claims the site was not safe for the service, arguing that workers neither dug the grave to the proper size nor covered the opening with plywood. She also said people weren't warned of the danger.

"It is not much fun being down there, where it's nice and black, and you are looking up and I am saying 'Jean, I don't want to go with you,'" May said of her late friend Jean Murphy Henderson.

Her husband, 92-year-old William May, claims the accident has cost him the affection of his wife. May wouldn't reveal her age but said she wasn't as old as her husband. The couple are suing for more than $75,000.

Bummer.

Thats why the majority toss flowers into the grave, rather then stepping up and placing them on the casket. Poor woman, hope she has a quick recovery...be spooky looking up from inside a grave.

They should make her walk home with a broken hip just for being stupid enough to fall into a grave.

Oi!! Not nice!!! She may not have had the best eyesight and WHY wasn't the open grave covered up anyway? A broken hip in an elderly person can be fatal.

Well if theres a hole in the ground its common sense to not walk to close to it so you fall in. just my point of view

I'm kind of doubting this woman is behind the lawsuit... I smell greedy heirs encouraging grandma to call her lawyer

If she were elderly, she may have had failing eyesight.

The grave should have been covered up.
