Yeah, in this case I would've been more outraged if the guy was 17 and the girl was 9 or 10. But I agree; rape is rape, and if he did rape her, then he belongs in jail.

I heard of another case where the guy was 19 and the girl was 17. The guy went to jail, and I heard him on the Montel Williams show stating that it's now on his record that he's a sexual predator. He says this has really messed up his life. This means he can't be around children. Cases like this one in my opinion make me sick; they're totally ridiculous. Whatever happened to teen dating? I don't think it was ever this bad.

No, by the law, a 16 year old that has sex with a 15 year old is not a pedophile. However, by the law, a SEVENTEEN year old that has sex with a 15 year old IS a pedophile. That is the law in that state. This is why the guy was charged. The law is very clear that AFTER the younger of the two is SIXteen, there can be a two year gap (16 and 18 year old, or 17 and 19 year old), but a child of 15 is not fair game for sex by someone that is two years older than them.

In the state in question, no a 15 year old is NOT capable of making that decision. Whether I agree with this or not, that is the LAW, and that is what is in question here. Other states have other laws for ages of consent... some are 18, some are 14 years old to make that decision. In this state, that age is sixteen.

The prosecution of 15 year old criminals is up to the laws of the jurisdiction in question. If they commit a crime that is outlined in a law, then they are charged and prosecuted. If not - they walk. In many cases, it is due to wording. I read the description of horse theft as written in Louisiana in the 1800's. It clearly said that if a man steals a horse, he can be charged, and sentenced to death. The way it was written, if you are a woman, you can steal as many horses as you like and can get away with it - as you aren't a "man." This is why it was changed... because a woman stole a bunch of horses and got away with it. If the law says that an 18+ year old person can't have sex with a 16 year old - then a 17 year old CAN... because they aren't 18 or over yet.
