Child Abducted by CPS after Parents Seek a Second Medical Opinion

A mother and father are incredibly grief-stricken following the abduction of their five-month-old son by police officers after merely requesting the child receive a second medical opinion.

Anna Nikolayev and her husband Alex took their son Sammy to the Sutter Memorial hospital in Sacramento to have his flu symptoms examined, but Anna became concerned with the care Sammy was receiving after a nurse failed to properly address why he was being given antibiotics.

“I asked her, for what is that? And she’s like, ‘I don’t know.’ I’m like, ‘you’re working as a nurse, and you don’t even know what to give to my baby for what,’” Anna told ABC affiliate News10. Anna later confirmed with a doctor that Sammy should not have been given antibiotics.

Since Sammy was born, he’s suffered from a heart murmur for which he had seen a specialist at the same hospital. Once Sammy underwent treatment for his flu symptoms, he was kept in the hospital’s pediatric ICU for monitoring, and after a few days doctors began recommending the couple allow them to perform heart surgery, which the couple refused.

“If we got the one mistake after another, I don’t want to have my baby have surgery in the hospital where I don’t feel safe,” Anna said.

Anna told doctors she would seek a second opinion and took her baby from the hospital without filing the proper discharge notice. “We went from one hospital to another. We just wanted to be safe, that he is in good hands,” Anna said, demonstrating an obvious effort to procure adequate medical attention.

Police showed up at the Nikolayev’s house not once, but twice demanding they surrender their child. “They told us that Sutter was telling them so much bad stuff that they thought that this baby is dying on our arms,” Anna said.

During the first police encounter, Anna showed them Sammy was indeed healthy, and also volunteered a doctor’s note clearly stating there was no “concern for the safety of the child at home with his parents.”

That day police thanked her and left, only to return the following day.

Alex recalled to reporters the dramatic quarrel as police bullied their way inside his house, stating, “I was pushed against the building, smacked down. I said, ‘am I being placed under arrest?’ He smacked me down onto the ground, yelled out, ‘I think I got the keys to the house.’”

I was in tears after watching this video. My heart goes out to these young parents, and pray they get their beautiful baby back. :cry:

I hope to God these parents sue this hospital and sue CPS and the cops who committed this atrocity. May God have mercy on their pathetic souls. (If they have one!)

I don't know what country these CPS idiots and cops think they live in. This is AMERICA.

I can't even begin to imagine this poor Mom's pain and anguish. I think this is every parents worst nightmare. When will this c**** STOP! WHEN?! :cry:

The poor people at Child Protective Services are damned when they do and damned when they don't. That's the #1 reason why I could never be a social worker. It's not dealing with the problems that would bother me, it's all the critics that would bother me.

There is NO justification for this. None at all. I'm sorry, but CPS (Gestapo) needs to be reigned in. ALOT.

Those idiots hold too much power, just like the IRS.

Do you know how many kids I've seen abused, and CPS is called, and they do NOTHING. Then they pull c**** like this! CPS is the epitome of "incompetence."

i wasnt classed as completely deaf until four years old, my mother took me to a specialist and they confirmed and fixed my hearing. i now have excellent hearing.

my mother gave birth to a still born and still thought she was pregnant with another baby but the doctors refused to listen and thought she was imagining it. they almost gave my mom meds that could of damaged me but luckily labor started to prove doctors wrong.

It is not illegal and nothing is wrong with taking a child out of the hospital against medical advice, especially if they aren't getting adequate care.

Which means she signed out her child AMA. Which is:

Against Medical Advice, or AMA, sometimes known as DAMA, Discharge Against Medical Advice, is a term used with a patient who checks himself or herself out of a hospital against the advice of their doctor.[1] While it may not be medically wise for the person to leave early, in most cases the wishes of the patient are considered controlling.[2] The patient is usually asked to sign a form stating that he or she is aware that they are leaving the facility against medical advice, and the AMA term is used on reports concerning the patient. This is for legal reasons to limit liability on the part of the medical facility in case there are complications.

She took him to ANOTHER hospital, and had another doctor check him out, and they said the baby was FINE. They even produced a doctors note saying the baby was fine to come home with the parents. And they STILL took the child away.

Heart surgery is serious and I can't blame them for wanting a second opinion but they should of had the baby transferred to another hospital if the child was that ill.

Wish CPS would of stepped in when the religious people let their first child die because they wouldn't seek medical attention at all.

That is exactly why you need a second opinion. When I had massive heart failure and was in the hospital my doctor's group started talking about putting in a defibrillator and getting me on the list for a heart transplant. I left the hospital and found another doctor. The new doctor put me on a miriad of medications and five years later I'm still alive.

Actually the baby wasn't that ill. They took him to another hospital. Another doctor examined the baby.

When doctors began discussing the possibility of heart surgery, the parents decided to leave without a proper discharge in order to have the child examined elsewhere.

“If we got the one mistake after another, I don’t want to have my baby have surgery in the hospital where I don’t feel safe,” Anna said.

She added, ”We went from one hospital to another. We just wanted to be safe, that he is in good hands.”

While at Kaiser Permanente, the police showed up at the request of Sutter. The police told the parents that staff at Sutter had told them that the child was in such a bad state that, as Anna put it, “they thought that this baby is dying on our arms.”

After the police saw that baby Sammy was fine and examined medical records that clearly stated that Sammy was clinically safe to go home, they left.

The attending doctor at Kaiser said, “I do not have concern for the safety of the child at home with his parents.”

I do have to agree with you on your last statement, though. Those religious people had not one but TWO children die because they WOULDN'T seek medical advice!

Heart murmurs are very common and usually not a cause of any real concern.

Around 85 percent of babies exhibit heart murmur during the first 24 hours after birth. It disappears within the next 48 hours. These murmurs are caused, as the babies have smaller blood vessels. Babies do not breath when they are inside the mother's uterus. When they are born, the blood flow to the lungs causes the veins to grow and the turbulence of the blood flow produces heart murmur. Most of the time, blood flow through the valves can be audible. This is because some infants may have a faster heart rate, causing the blood to flow at a higher speed. This speed produces a sound, which is heard as a murmur.

Older children can also have heart murmurs, which tend to come and go. Few children have chest walls which are thinner, thus, these sounds become more audible. These type of murmurs are known as innocent murmurs. They are not caused by the heart defects. Parents should not worry about such murmurs. A few murmurs can also be caused by stress, fear, anemia or fever. The narrow blood vessels can also cause a heart murmur.

I would also like to point out, certain medications can also cause heart murmurs, especially certain common ANTIBIOTICS.

I know several people who can't take some common antibiotics that are given out, because it causes them to have heart murmurs.

But for one couple, the decision to get a second opinion for their baby boy’s illness ultimately resulted in police forcibly removing the infant from their California home, RT.com reported.

Anna and Alex Nikolayev, a young Russian couple living in Sacramento, took their 5-month-old son Sammy to Sutter Memorial Hospital in Sacramento when he started to exhibit flu-like symptoms. The Nikolayevs had been taking Sammy to Sutter Memorial since his birth, when had been diagnosed with a heart murmur.

When they arrived at the hospital, Sammy was taken to the Intensive Care Unit. But soon, the couple became concerned about their son’s treatment, after Anna witnessed a nurse giving Sammy antibiotics – something a doctor had not instructed her to do.

“I asked her, ‘For what is that?’ And she’s like ‘I don’t know.’ And then I said ‘You’re working as a nurse, and you don’t know what you’re giving my baby?’” Anna Nikolayev told News 10, a Sacramento ABC affiliate.

A doctor confirmed to the worried mother that her child should not have been given antibiotics; however, doctors told Anna they wanted to perform open heart surgery on Sammy as soon as possible. At that point, Anna thought she may need a second opinion for her son – a decision her doctors were adamantly against.

“If [they made] one mistake after another, I don’t want to let my baby have surgery in the hospital where I don’t feel safe,” Anna told News 10.

God, this whole story just makes me sick....

Unfortunately the government feels otherwise. I have posted before. The child protection laws in almost all states came in a wave in the 80s. They almost always state that the safety of the child is paramount. Paramount is a legal term that means above all other laws and concerns. CPS can break any law, can lie in court, to justify their ends. Parents rights are beneath these laws as well.

A large, well most of the country is blissfully unaware of this. They pop out kids, think they can make their own decisions about healthcare. But the FACT is quite different. There are many cases EXACTLY like this one. Families are messed with, messed up and you would be HORRIFIED. They don't get air time because who wants the world to know their family business? The cases are behind closed doors and secret court orders.

Child protection services has nothing to do with Insurance reform from Obamacare. And ObamaCare is not healthcare.

SHE signed him out. Thus SHE had responsibility. The states feel they can do better than parents (see my previous post). Especially children. They feel that if you are looking for second opinions, you are not a good parent.

I can prove it's illegal in many states to get second opinions for children (I can't do it here, but I can prove it) I have documents by a real judge.

Doctors are wrong a lot. But apparently to CPS, that's reasons enough for taking your kids away.
