Gambler sues Casino

Southern California gambler Mark Johnston, 52, is suing the Downtown Grand for loaning him money and serving him drinks when he was visibly intoxicated.

Nevada law bars casinos from allowing obviously drunk patrons to gamble and from serving them comped drinks.

Johnston's attorney, Sean Lyttle, says the Grand, which opened last November in the old part of Las Vegas,

intends to pursue Johnston for trying to shirk his gambling debts.

Johnston put a stop-payment order on the markers, or casino credits, the Grand issued, and is also seeking damages

from the Grand for sullying his name.

Johnston says he was thoroughly drunk during the hours he spent playing pai gow and blackjack at the Grand. His legal team plans to rely on eyewitness testimony and surveillance video to prove that he was visibly intoxicated.

He was too drunk to walk away and way too drunk to run. But whatever happened to personal responsibility for one's actions?

So..where is Mr. Johnstons responsibility in all this. Surely he had to know, at some point, that he was getting tipsy so why is it someone else's fault that he deliberately got drunk?

After all it seems that he knew he was drunk yet he chose to keep drinking; it is his own fault, he should pony up and face the consequences.

#1: Never gamble with money you cannot afford to lose.

#2: Never gamble while drinking heavily.

#3: Never borrow money to gamble.

#4: Never chase a winner when you are losing; walk away.

#5: Know when to quit; winning or losing.

Like you say, he was responsible... no one poured drink down his throat and he wasn't cuffed to the tables. I feel sorry for him but it's his own damn fault.

Casinos should not offer loans on markers - that is their responsibility because a person entering into a loan agreement needs to be sober and lucid about what they are entering into.

I'm going to await the verdict on the surveillance video etc by the courts. If you empty your pockets that's one thing, but offering loans is self serving and gratuitous of the casino if that is what happened.

Sorry..anyone who can afford to risk losing that kind of money, drunk or sober, does not get my sympathy. Thats just insane...he does not need a lawyer, he needs a shrink.

Exactly. If I sued for every bone head move I ever made the courts would be tied up forever. Alcohol effects judgement so while drinking you might do stupid things but it should be easy enough to figure that out after a few episodes.

I've been told that my Grandpa G liked to gamble. If he was still alive I wonder what he would think of this man. I can only imagine.
