I still reflect on the thought/situation/what one would call it, if a tree falls in a forest when no one is around, does it make a sound?

I know, if I'm no where at all, in the spot when the tree falls, I know I won't hear it. I base this, of growing up, not hearing it, if I hadn't been around myself when all lonely trees fall in forests.

Despite that trees do fall and sounds do come from this, when observed. ( it can be shared on varying occasions that it's not always the same sounds, since falling trees have different patterns. )

So, if I see no evidence, I hear no sounds. Even with that one individual's experience, does that count?

Also, if I don't pay any mind to falling tree, so I don't notice there is probably a sound, then the sound does not travel to me.

It becomes ............................................. nothing to me.

It can end up being a diseased, with poison ivy all over it, type of tree.

I will not acknowledge that there might be a sound coming from it, if I'm waaaay over there.

You know, to notice the tiny house someone planted over on that lot, that looks so cool!

.................................... and if a ghost happens to wildly haunt it!

You don't know the law at all. It doesn't mater what names we use on a forum. If you defame me by comments on a forum which are written to be factual ie pertaining to my real persona or (as another example) you access child pornography using an avatar, then the real you remains legally liable. It has been decided some time ago that anonymity on a forum is no protection for defamation or indeed any other crime, if comments are directed at the real person behind the avatar. .

This is the US law and Australian defamation laws are even tougher.

Yes, you can be sued for libel for something you write on a forum.

If you write something defamatory about a person who is recognizable and identifiable, the person you defamed can file a suit against you. If you are "anonymous" online, the person will file a "John Doe" lawsuit and the court will order the website to reveal your real identity so that the lawsuit can proceed against you. You will generally be notified about the court order prior to your identity being revealed, so that you have an opportunity to respond to the lawsuit before your identity is revealed.

There is, quite frankly, no real anonymity on the Internet, so you must be careful what you write.

If what you wrote is true, that would be a legitimate defense to any libel action brought against you, but it does not prevent a lawsuit from being filed in the first place. You would use "truth" as your defense in court - and to use truth as your defense, you would have to prove that what you wrote was, in fact, true, or was reasonably believed by you to be true.

Truth will NOT protect you against an invasion of privacy action, however, if you reveal information about someone that is true but confidential or true but potentially embarassing for the individual.

The "punishment" for libel varies.

For any defamation action, the individual defamed would have to demonstrate reputational injury suffered as a result of the comments made. Because reputations do not come with a price tag, an individual defamed will ask for a LOT of money to compensate for his injury. Money awarded for injury to a reputation is called compensatory or general damages. Pecuniary damages can also be awarded - these are actual monetary losses suffered as a result of the defamation, occurring from the loss of a job or the loss of a promotion, for instance. Additional damages can be awarded for pain and suffering, although this is not common.

Defamation suits are expensive to bring - and even more expensive to lose. It is certainly better to never to say anything defamatory about anyone ever.

Again very good pull Stubbs, you are correct, there is a fine line between perception ( sense experience) and perspective (our spin on it).

And some perspectives we could lock up and throw away the key, namely, terrorism or trolling comes to mind.

I had a situation where there was an attempt to defame my character, there was a poster who was against home school charter ( for whatever reasons) I think her experience of home schooling ended up costing her a big chunk of money to Sylvan, and in her well meaning way she wanted to make sure I didn't have the same outcome.

I didn't take her advice even though I respected her input, the problem was to be right she made up that Charters were so bad that her state had them and voted them out due to the ineptness and harm they had caused the kids. This was early in the home schooling days when one was a leper for going this route, (and she had gone it so she had her experience, too). It led to a lot of heat for me on the board as I home schooled. Then, another poster did some research and found out her state never even had charters to begin with.

I didn't troll her, or threaten a law suit, I just told her openly that she was wrong for doing that, she did say she thought I knew she was only kidding, I said I did not know that and we never had an issue again. Fair enough.

In retrospect, the problem was she thought she knew what was best for me drawing off her experience, and she had said that, but my situation wasn't like hers, or in a time when there were little resources. I had my ducks in a row, and had the resources and mentors to home school effectively, she just couldn't see that as it wasn't part of the reality she knew. Yet, her concerns were valid, and had I have been trying to unschool the method she used ( let my kid learn whatever they please) it would have been viable advice.

So even though it didn't serve me, it was good to know in case anyone else needed to hear the dark side of not being prepared.

And the heat I took was to be expected for the path I was on, I was prepared for it, the lieing part was shady, but what came out of it was always have the facts, had I have researched myself I could have ended the situation sooner. And, not everyone is going to approve or agree, or like me, nor do they have to. I never did the defense thing, there was nothing for me to defend, people have a right to their opinion, and if it bothered me then it was an opp. for me to have a better self esteem, or take a break from UM, and if comments really are nasty report them, UM will remove them.

Even if you did know the law Walkies ... your comprehension of things, not being able to follow the thread of a conversation and other 'issues' you have would self sabotage you .... its a great tactic ... at one stage in our case, we just let them run , our solicitor wanted to know what to do about that. Nothing I said ... give 'em enough rope and ....

yes they are very expensive to bring ... the fees are ridiculous, each lodgement of action or motion can cost over $1000, then there are legal fees, and if you lost, you would have to pay all those ( Supreme court services and Judges wages can cost a bit too ) and you solicitor's fees , and my expenses as well . .... all because you were incapable of getting a joke .

The only argument you might have in this example is that I am not "recognisable and identifiable@ However my lawyer would argue that i am, given the amount of information given on-line about me It took me less than five minutes in a search to find who i really am, using only information available on this forum.

I find it weird that you cannot see this. If you acted like that in real life you would have a life filled with strife and conflict.

I do act like this in real life . I have a life filled with excitement, little conflict and a lot of laughter ..... you see, the thing is, if someone starts up on me , like you did, I can serve it back with eggs on ... then . often, the go and get all girly wingey upset ... unless they can have a laugh at themselves ... like I can .

All that response when i said i had no intention of taking you to court BUT you are simply wrong. When you accuse me of being fired for hurting a child, it is the real me not the avatar, mr walker, you are speaking of. Case law precedence established this about a decade ago in Australia. Mr walker lives in the jungle and only ever home schooled kids. I on the other hand was employed by the eduction dept from 1966 to 2015

If you are telling the truth you did well to win your case, but then it was fairly clear that, legally, you were always in the right, then. This time legally you would be in the wrong.

The law is established on this matter.

Also hiding defamation as humour is not a defence in Australia. You can tell jokes about politicians but if a joke defames them, you are still liable.

The rest of your post is, again, simple personal abuse, and again I am amazed that you are foolish enough to show others the true nastiness of your character. Obviously you suffered some deep trauma in your life which made you this way,.and i feel very sorry for you.

Defending your self is one thing and always legitimate, but simply provoking people and then claiming self defence is stupid. One day you will get badly hurt.

Oh and don't concern yourself about the expense of such a case There are two good lawyers in my family, and several among my ex students, who would happily represent me pro bono, and if i needed any extra advice i might have a chat to an old mate of mine, Chris Kourakis, whose brother i went to school with .

nah ... I only beat the State Attorney General at law in the Supreme Court ... and ran rings around the crown Solicitor ..... and made complex puns that neither of them got but the judge did ( I could tell as she was smirking silently when I did. )

Even if you did know the law Walkies ... your comprehension of things, not being able to follow the thread of a conversation and other 'issues' you have would self sabotage you .... its a great tactic ... at one stage in our case, we just let them run , our solicitor wanted to know what to do about that. Nothing I said ... give 'em enough rope and ....

... and they did . With your ability to neck yourself and step right in it , I am sure the court would be greatly entertained by you.

yes they are very expensive to bring ... the fees are ridiculous, each lodgement of action or motion can cost over $1000, then there are legal fees, and if you lost, you would have to pay all those ( Supreme court services and Judges wages can cost a bit too ) and you solicitor's fees , and my expenses as well . .... all because you were incapable of getting a joke .

Oh, I would love to see that 5 minute demo in court

Thus demonstrating, not that I could do that , but that you could find out who you were .

I do act like this in real life . I have a life filled with excitement, little conflict and a lot of laughter ..... you see, the thing is, if someone starts up on me , like you did, I can serve it back with eggs on ... then . often, the go and get all girly wingey upset ... unless they can have a laugh at themselves ... like I can .

Nah .... you got that wrong as well . I am emotionally balanced, have a high intellect, strong psychic powers, a solid psychology ... so I am pretty hard to best or call to account ..... then , some brutish morons ( who like to think they can 'punish people' may try to get physical about it ... I dont mind that at all , I can actually take care of myself, in some cases against multiple armed assailants .

That does make me unpopular with some would be alpha-male types who have tried to lord it others with their superiority viewpoints and high opinions of themselves. ... because their usual response is to get physically aggressive when they get beaten at their own game ... but then they either back down, as they know about me ... or they soon learn .

However, this approach of mine, and my multiple skill set in dealing with dorks and such would be alpha-males, makes me popular with others who dont do that ... and women ... wh get rather sick of these big loud mouths trying to run the show all the time

I reccomend posture improvement for that one ... dont stoop so much, get your nose up in the fresh air !

Again very good pull Stubbs, you are correct, there is a fine line between perception ( sense experience) and perspective (our spin on it).

And some perspectives we could lock up and throw away the key, namely, terrorism or trolling comes to mind.

I had a situation where there was an attempt to defame my character, there was a poster who was against home school charter ( for whatever reasons) I think her experience of home schooling ended up costing her a big chunk of money to Sylvan, and in her well meaning way she wanted to make sure I didn't have the same outcome.

I didn't take her advice even though I respected her input, the problem was to be right she made up that Charters were so bad that her state had them and voted them out due to the ineptness and harm they had caused the kids. This was early in the home schooling days when one was a leper for going this route, (and she had gone it so she had her experience, too). It led to a lot of heat for me on the board as I home schooled. Then, another poster did some research and found out her state never even had charters to begin with.

I didn't troll her, or threaten a law suit, I just told her openly that she was wrong for doing that, she did say she thought I knew she was only kidding, I said I did not know that and we never had an issue again. Fair enough.

In retrospect, the problem was she thought she knew what was best for me drawing off her experience, and she had said that, but my situation wasn't like hers, or in a time when there were little resources. I had my ducks in a row, and had the resources and mentors to home school effectively, she just couldn't see that as it wasn't part of the reality she knew. Yet, her concerns were valid, and had I have been trying to unschool the method she used ( let my kid learn whatever they please) it would have been viable advice.

So even though it didn't serve me, it was good to know in case anyone else needed to hear the dark side of not being prepared.

And the heat I took was to be expected for the path I was on, I was prepared for it, the lieing part was shady, but what came out of it was always have the facts, had I have researched myself I could have ended the situation sooner. And, not everyone is going to approve or agree, or like me, nor do they have to. I never did the defense thing, there was nothing for me to defend, people have a right to their opinion, and if it bothered me then it was an opp. for me to have a better self esteem, or take a break from UM, and if comments really are nasty report them, UM will remove them.

This must have happened during one of my times away from here. But yes, I have noticed that about UM. Always learning on here.

I think if our perspectives are important to want them to have a message with it, then we send the message with the kindest manner ever!

I feel bad you have that experience, though.

We handle threats a little differently in my part of the backwoods.
