According to you.  The Militia Act of 1903 codifies that not all militias are "approved" by a state.

Still waiting on someone to post the vaunted "Constitution of Common Sense"...

"Common Sense" usually equates to what the individual spouting said common sense thinks is a good idea at the moment.

Sticking to what is codified as Constitutional Law trumps any nebulous ideas of "common sense".
