H.R.6054 Unmasking Antifa Act

IN THE HOUSE OF REPRESENTATIVES
June 8, 2018

Mr. Donovan (for himself, Mr. King of New York, Mr. Budd, and Mr. Gosar) introduced the following bill; which was referred to the Committee on the Judiciary


A BILL

To amend title 18, United States Code, to provide penalty enhancements for committing certain offenses while in disguise, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. Short title.

This Act may be cited as the “Unmasking Antifa Act of 2018”.

SEC. 2. Interference with protected rights while in disguise.

 

(a) In general.—Chapter 13 of title 18, United States Code, is amended by inserting after section 249 the following:

§ 250. Interference with protected rights while in disguise

“(a) In general.—Whoever, whether or not acting under color of law, while in disguise, including while wearing a mask, injures, oppresses, threatens, or intimidates any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same, shall be fined under this title, imprisoned not more than 15 years, or both.

“(b) Rule of construction.—Nothing in this section shall be construed so as to deter any law enforcement officer from lawfully carrying out the duties of his office; and no law enforcement officer shall be considered to be in violation of this section for lawfully carrying out the duties of his office or lawfully enforcing ordinances and laws of the United States, the District of Columbia, any of the several States, or any political subdivision of a State. For purposes of the preceding sentence, the term ‘law enforcement officer’ means any officer of the United States, the District of Columbia, a State, or political subdivision of a State, who is empowered by law to conduct investigations of, or make arrests because of, offenses against the United States, the District of Columbia, a State, or a political subdivision of a State.”.

(b) Clerical amendment.—The table of sections for chapter 13 of title 18, United States Code, is amended by inserting after the item related to section 249 the following:


“250. Interference with protected rights while in disguise. ”.

SEC. 3. Destroying buildings or property within special maritime and territorial jurisdiction while in disguise.

Section 1363 of title 18, United States Code, is amended by adding at the end the following: “Whoever, during the commission of an offense under this section, wears a disguise, including a mask, shall, in addition to any term of imprisonment otherwise imposed under this section, be imprisoned for 2 years.”.

Notably the police would still be free to disguise themselves while violating your rights, otherwise I'm in agreement with this.

Good. Pretty much by definition, any one showing up to an event wearing a mask is there to cause trouble. There are very few reasons to intentionally cover your face in public.

If you guys are looking for a laugh, head over to YouTube and watch "ANTIFA unmasked" videos. As it turns out, the best way to fight these skinny cowards isn't with your fists, it's with your finger tips. Just yank the bandanna off their face and watch them immediately run back to the safety of their crowd lol

They are more terrified of being exposed than beaten up. What does that say about their intentions?

At least one state classifies Antifa as a domestic terrorist organization. Alabama police forced them to remove their "masks" at a college protest last year. The proposed law is a good way to greatly reduce mayhem and violence. People are more likely to commit crimes when their identities are hidden.

Pretty much.  Masks for holidays or celebrations are one thing since those events are meant to be fun and joyful.  Masks for protests or other events that are based on frustration and anger are NOT a place for masked groups of people.

Welp guess im Keyser Soze today...……………………...  the second amendment wont be a whole ton of help if the government can simply use facial recognition to round up folks who protest whilst on their way to work , daycare etc. 

Thats the thing with bills like this. Folks forget this could and would go both ways.

With technology growing the way it is, masks aren't going to do people a whole lot of good for much longer anyways.  Might as well strip away the masks and anonymity now to get the populace used to it.  We are arresting people now based on DNA evidence that they compare on databases like Ancestry.  They don't even need your DNA on file, they can narrow you down from a relative's DNA.  Facial recognition technology is here, next will be body and posture recognition.  They can find your position with your cellphone. Frankly, the future doesn't hold much in store for public privacy for the average Joe, let alone lawbreakers.

I know and I understand all of that but I guess im something of a romantic stuck hoping eventually something will be a bridge too far

They're not making it against the law to hide your face, but if you're hiding your identity while infringing the free speech/expression rights of others then this law would come into play.

Yep. Thermal cameras, voice recognition and tracking software, not to mention the thousands of ways they can track you online...throw it all in a blender with DARPA robots and you have a delicious, dystopian smoothie. They track you to your apartment complex with drones and dragnet surveillance then send the robot grunts in there to get you.

If someone sees us heading in a different direction, help me sleep better tonight by telling me why. The technology and the infrastructure already exist, it just needs more cohesion and motive to become a system of extreme control.

Eh, lob some tear gas into a rowdy crowd and you can use this law to arrest anyone that covers their face.

If you're lobbing teargas around you are probably too the point of making up some charges if you feel like it already.

The solution of course will be to stop wearing masks while standing up for your beliefs.  Or better yet realize that 99% of protests result in zero change and stay home to play your guitar.

The 200 or so J20 protestors weren't all wearing masks and there was over 100 protests that day so maybe one resulted in change.  Kind of getting away from my point which is that this law would be a great way to arrest people right after you tear gas them.

That's not what the bill says:

I can see it now, "That mean counter protestor was very loud and intimidating.  He also covered his face when a tear gas canister landed near him.  Fifteen years in jail!"

We're not reading it the same way but don't worry it probably won't pass anywise.

It really kicked into gear after 9/11. I knew that things were out of control when they first frisked old folks and young kids at airports. It got worse after that. The trend just grew. They took the airport madness to buses and trains, and they also took it to events with large crowds. Some of it was justified. That aside, it always seemed as though they used terrorism as an excuse as they instituted more steps in the slow walk to a police state. Most people were proverbial frogs in boiling pans of water.
