US approval of child bride immigration

Eldorado

Recommended Posts

Thousands of requests by men to bring in child and adolescent brides to live in the United States were approved over the past decade, according to government data obtained by The Associated Press.

In one case, a 49-year-old man applied for admission for a 15-year-old girl.

The approvals are legal: The Immigration and Nationality Act does not set minimum age requirements. And in weighing petitions for spouses or fiancees, U.S. Citizenship and Immigration Services goes by whether the marriage is legal in the home country and then whether the marriage would be legal in the state where the petitioner lives.

But the data raises questions about whether the immigration system may be enabling forced marriage and about how U.S. laws may be compounding the problem despite efforts to limit child and forced marriage. Marriage between adults and minors is not uncommon in the United States, and most states allow children to marry with some restrictions.

There were more than 5,000 cases of adults petitioning on behalf of minors and nearly 3,000 examples of minors seeking to bring in older spouses or fiances, according to the data requested by the Senate Homeland Security Committee in 2017 and compiled into a report.

Thanks for that Eldorado.

I also discovered the Wiki article on it. Apparently - with parental approval - you can marry at the age of 15 in Missouri and Hawaii !!

The Mormons own half of Hawaii, so I'm not shocked.

you still need to be of legal age to get marriage license, each state makes their own age limit, if underage, legal guardian consent is required.  afaik K1 visas are not granted to legal guardians. and future fiance can not be a legal guardian.

That is so wrong.

So a paedo can get away with it in the US if he marries her outside the country then ships her in?

no, it makes thing much more complicated to marry her in another country, especially underage, the article is about K1 fiance visa approval.

nope, fiance visa means she has 90 days here to get married, or she goes home if she does not., or becomes illegal if she stays

yep. on paper he can , but in reality, good luck.  unless you have religious grounds , you'll have to go thru hell to get here her legally.  this story is nothing but making a mountain out of molehill

what this story actually ignores, that underage wives are brought for underage husbands, in vast majority of cases.  in some culture\religions it is normal, and they keep practicing such beliefs and traditions here. it has nothing to do with sex slavery,

This. Arranged marriages are still practiced widely.

it's true, that law may be 200 years old, however newer laws of statutory rape really negate it

In some states, it is possible for a minor to legally marry even if they are below the age of sexual consent in that state.

Between 2000 and 2015, at least 200,000 minors were legally married in the US. 86% of these marriages were to an adult.

About 5% of the minors were aged 15 and under meaning they would be under the age of sexual consent anywhere in the USA.

State laws on age of sexual consent and age of marriage are very inconsistent. In some cases, judges who approve underage marriages are approving a marriage between a rapist and their victim.

https://en.wikipedia.org/wiki/Child_marriage_in_the_United_States

as of January 2019:

17 states have no minimum age of marriage in some cases.
2 states have a minimum age of 14.
5 states have a minimum age of 15.
19 states have a minimum age of 16.
7 states have a minimum age of 17.

it sure sounds bad on paper, but "adult" is something that is also up to states, i see no harm when a 17 y.o. marries 19 y.o (legally adult in some states) due to their religion or tradition.  actually it is mostly practiced by Muslims, and hindus
