CPS sinks Patel's asylum seeker bill

The Crown Prosecution Service’s decision not to prosecute asylum seekers crossing the Channel illegally will prompt more to make the journey, Tories have warned.

However, the CPS said the change was made following a consultation with the Home Office and had been in development for a long time. It said it was not in response to the JCWI but following the implications of case law and inconsistency in the enforcement of the legislation in the wake of the rise in small boat crossings.

Nick Timothy, who served as Theresa May’s special adviser on immigration policy during her time as home secretary, said: “The CPS has just sent a ‘Come to Britain’ advert to every would-be illegal immigrant in the world, and to the organised crime gangs and people traffickers who facilitate them.”

The decision by the CPS has dealt a blow to the plans of Priti Patel, the home secretary, to crack down on Channel crossings. Present legislation allows the prosecution of asylum seekers only if they “enter” the country. However, the vast majority do not technically enter the country illegally as they are intercepted by Border Force and escorted into a port.

Patel revealed a proposed new offence in the Nationality and Borders Bill on Tuesday that would apply to those “arriving in the UK without a valid entry clearance”. It carries a penalty of up to four years in jail. If the offence had been on the statute book last year, it would have left more than 8,000 asylum seekers facing a jail sentence. Tories say CPS decision is an invitation to immigrants | News | The Times

A French warship escorted a group of 13 migrants crammed into a small boat into British waters before handing them over to a baffled news crew this morning, as hundreds are expected to cross today after more than 430 people landed in the UK yesterday in a single-day record. 

Ms Tomson said GMB alerted Border Force to the small boat, but agreed to 'observe' the migrants because UK officials were so busy handling other crossings this morning. Around 20 minutes later, a Border Force jet-ski was filmed escorting the dinghy to the English coastline.

Appearing on GMB this morning, Business Minister Paul Scully said the migrants were escaping war-torn countries and said 'people should be claiming asylum in the first safe port' they reach.

France struck a deal with the UK in November to tackle illegal Channel crossings but has so far resisted the idea of having dinghies sent back to its northern beaches.  

A further 12 migrants - mainly men - were filmed successfully landing their orange rigid hulled inflatable boat on the pebbles at Dungeness, Kent at 11.15am. One African migrant told photographers on the beach the group had paid £3,000 each for the 10 hour crossing, while another was seen wearing a denim jacket with the slogan 'live or die' emblazoned on the back. 

It comes after more than 430 migrants sailed across the Channel yesterday in a new single-day record. Monday's figure passes the previous daily high of 416 set in September last year, official figures show.

Priti Patel strikes deal as number of people making voyage this year reaches 8,452, eclipsing 2020’s total

The UK taxpayer is to hand over a further €62.7m (£55m) to France to fund another clampdown on small-boat crossings of the Channel, the Home Office has revealed.

The home secretary, Priti Patel, agreed to pay the sum as part of a deal reached with the French interior minister, Gérald Darmanin, on Tuesday.

At least 430 people crossed the Dover Strait on Monday, a record for a single day.

On Tuesday more than 287 migrants succeeded in reaching the UK, bringing the total for the year to at least 8,452, according to available official data compiled by PA Media.

It means the number of people who have made the dangerous journey across the Channel in small boats this year has passed the total for all of 2020 – with more than five months of 2021 to go.
