el midgetron Posted August 6, 2021 #1 Share Posted August 6, 2021 Quote President Biden's extension of the eviction moratorium is unconstitutional and he knows it Biden had “asked the CDC to look at whether you could even do targeted eviction moratorium – that just went to the counties that have higher rates – and they, as well, have been unable to find the legal authority...” Speaking at his press conference Tuesday, Biden reiterated these findings. “The bulk of the constitutional scholarship,” Biden conceded, “says it’s not likely to pass constitutional muster,” as, he noted, did the Supreme Court, which ruled in June that the scheme “exceeded its existing statutory authority” and could not be extended without explicit congressional approval. But, Biden said, he had decided he was going to do it anyway – if just to exploit the time it would take before the judicial branch struck it down. https://www.usatoday.com/story/opinion/2021/08/05/eviction-moratorium-delta-variant-brett-kavanaugh-unconstitutional/5498649001/ Quote Biden teases new eviction freeze, admits likely unconstitutional https://nypost.com/2021/08/03/biden-to-extend-eviction-ban-in-places-with-high-covid-rates-report/
Raptor Witness Posted August 6, 2021 #2 Share Posted August 6, 2021 Does it make sense to be evicting people in the middle of the Delta wave? The Executive Branch does have emergency powers, as it should. You're being overly dramatic, over something designed to help mitigate a pandemic. This is called, leadership, instead of the endless denials of reality by Biden's crybaby predecessor. 4

Michelle Posted August 6, 2021 #7 Share Posted August 6, 2021 Biden's new evictions moratorium faces doubts on legality in Tennessee, other states WASHINGTON (AP) — President Joe Biden may have averted a flood of evictions and solved a growing political problem when his administration reinstated a temporary ban on evictions because of the COVID-19 crisis. But he left his lawyers with legal arguments that even he acknowledges might not stand up in court. The new eviction moratorium announced Tuesday by the Centers for Disease Control and Prevention could run into opposition at the Supreme Court, where one justice in late June warned the administration not to act further without explicit congressional approval. cont... https://www.wrcbtv.com/story/44461565/bidens-new-evictions-moratorium-faces-doubts-on-legality-in-tennessee-other-states

The only thing that has changed is the fact that you are frustrated about this entire situation and you would rather see people evicted because it fits your political beliefs which is to damage the Biden Administration even at the cost of millions of Americans being put out in the street. But honestly your opinion and that's all your offering doesn't mean anything at all. If I were you, .I would pay attention to your own home front, Trumps Brother, your PM is as bad or worst than Trump himself. preacherman76 Posted August 6, 2021 #12 Share Posted August 6, 2021 Of course it unconstitutional. Where in the constitution does it allow the government to force people who own rentals to take massive financial hits to the point where they themselves are going to lose the property? Many rentals are owned by people who just have one or two properties for rent. They can’t afford for the tenants to not pay rent. On top of that there are millions of people who have worked this whole time, and could have paid rent, but knew they couldn’t be kicked out if they didn’t. I personally know a guy who has 2 rentals. He can no longer afford to house people for free like he has been doing now for over a year. But he is being forced to. His tenants have worked this whole time, and just refuse to pay. So he has to pay, for taxes and utilities. If he refuses he will go to jail. Why should he be held responsible and be taken advantage of? This has to end. Government has no business in these private agreements.
Myles Posted August 6, 2021 #13 Share Posted August 6, 2021 In theory it is/was a good thing. In practice it has failed horribly. Many landlords have not received government money. I think New York has been the worst. aztek Posted August 6, 2021 #19 Share Posted August 6, 2021 Biden, Dems’ eviction moratorium is progressive politics dressed up as public health The CDC does not have any authority to make economic policy Quote What is the difference between socialist economic policies and CDC public health measures? In the case of the federal eviction moratorium, it turns out it is none at all. Congressional Democrats failed to pass a federal eviction moratorium into law this week – but they did manage to pressure President Biden into extending the CDC moratorium. Democrats saw a moratorium as a legislative priority, framing it as a welfare measure to help millions of renters said to be facing eviction. When that that failed, Biden and the CDC came to the rescue. But the current justifications for keeping the moratorium are entirely different from the rational the Centers for Disease Control presented when they instituted the "emergency" measure two years ago. According to CDC, the moratorium was designed solely to prevent the spread of COVID. Indeed, the CDC does not have any authority to make economic policy. But the seamless transition now being witnessed from a supposed epidemiological intervention backed by experts to a typically partisan soak-the-rich policy suggests the moratorium was always progressive politics masquerading as public health. https://www.foxnews.com/opinion/biden-democrats-eviction-moratorium-progressive-politics-health-eugene-kontorovich
aztek Posted August 6, 2021 #20 Share Posted August 6, 2021 Quote Even as a safety measure, the moratorium was poorly supported by evidence. The CDC’s public health justification was based on entirely on a response to a Census question, in which one-third of renters self-reported that, in the hypothetical event they were evicted, they would move in with friends and family. Thus, the CDC reasoned, evictions could increase the spread of COVID. There is no actual evidence of the extent to which evictions increase crowding, let alone fuel the spread of COVID.
