A judgement in a landmark defamation trial says Australia's most-decorated living soldier lied to cover up his misconduct and threatened witnesses.

It also found Ben Roberts-Smith "complicit in and responsible for" the murder of four Afghans.

Last week, he lost a defamation suit against three Australian newspapers over war crimes allegations.

It has raised the spectre of a possible wider reckoning over claims of war crimes by Australian forces.

Then charge him in a tribunal!

If not,  then I don't think the court decision necessarily proveshim a criminal! My mind cannot help but jump to another relatively recent defamation case in London which allegedly proved Johnny Depp assaulted Amber Heard.  Of course, the very public civil trial proved otherwise.  A defamation trial only suggests that there's enough people saying something as to be worthy of repeating in print form!

If he's guilty then I hope he burns in a very special level of hell

Isn't the investigation into Robert Smith and quite a few others still active? 

The Brereton Report did conclude unlawful killing.

Maybe, but I'm not going to jump to conclusions based on a defamation trial! Definitely investigate him and if any charges need to be made then go for it.  But I give a lot of respect to those who serve in the armed forces, and benefit of the doubt goes his way until proven guilty, for my mind!

Of course our veterans deserve fair treatment. And IMHO from a military bench. War is a different world. I think those who understand it better should make these calls, military judges, but that's just opinion.

Did you read what the judge said in the defamation trial? 

I saw it on telly yesterday. I was surprised at it myself. It's quite damning.

Ummm... yeah... it's The Federal Court.  Noone is found gulty in the Federal Court.  It's not a criminal court.
