Man wrongly jailed for 17 years may be billed for his prison food and accommodation

Seems fair enough. He wasn't supposed to be in jail so he got it all under false pretenses. Some people are so entitled!

An innocent man who was wrongly jailed for 17 years for a rape he did not commit faces having to pay for prison 'board and lodging' as he blasted his 'kidnappers'.

Andrew Malkinson, now 57, on Wednesday finally won a 20-year battle to clear his name after he was in 2003 handed a life sentence with a minimum term of seven years, after being found guilty of raping a woman in Greater Manchester.

Mr Malkinson is now living on benefits but could be in line for up to £1million in compensation for his wrongful conviction – but his lawyer warned his client may be waiting 'years'.

Man wrongly jailed for 17 years to leave UK and rebuild life in the Netherlands after finally being freed

Andrew Malkinson plans to move to the Netherlands and travelled to Amsterdam this weekend.

The 57-year-old has been released from prison after DNA evidence linked another man to the crime.

"It's been a long time coming but this is the first day of the rest of my life," he told The Mirror.

"I was born here but I don't identify with it and it doesn't feel like home after what I've been through.

Documents in the case of Andy Malkinson show the DNA of another man was identified three years after he was wrongly jailed for rape.

Mr Malkinson was found guilty in 2004 of raping a woman in Greater Manchester and only had his conviction quashed last month at the Court of Appeal.

Questions have now been raised over why Mr Malkinson was not granted an appeal as long ago as 2009.

Hw should get compensation for all that time in jail, not made to pay for incarceration

I've just been listening to a debate about this. The law says that someone falsely punished should be financially compensated for the financial harm they have suffered. So if he could have earned, say, 20k per year if he was on the outside, he would get 17x 20k, plus compensation for emotional harm. But since he would have had to pay for food and rent/mortgage anyway if he had not been incarcerated, that much is deducted from his financial package. Doesn't seem fair,though, does it?

That is just bull**** IMO, he had his freedom taken away.  He had all those years stolen from him, he deserves compensation.  To DARE charge him his room and board is just beyond ridiculous.   He had no choice...I can't even fathom how anyone could justify charging him for this.

The Wrong Man: 17 Years Behind Bars review – dignified, devastating TV

This mind-boggling documentary about a man who was imprisoned for a crime he didn’t commit will prompt rage, tears – and a sense of wild injustice

Documentaries about miscarriages of justice tend to be designed to make viewers angry. The Wrong Man certainly achieves that, not least because it concludes with the unbelievable news that Malkinson has not received a penny of compensation for his ordeal.
