An innocent man who was wrongly jailed for 17 years for a rape he did not commit faces having to pay for prison 'board and lodging' as he blasted his 'kidnappers'. Andrew Malkinson, now 57, on Wednesday finally won a 20-year battle to clear his name after he was in 2003 handed a life sentence with a minimum term of seven years, after being found guilty of raping a woman in Greater Manchester. Mr Malkinson is now living on benefits but could be in line for up to £1million in compensation for his wrongful conviction – but his lawyer warned his client may be waiting 'years'. The 57-year-old has been released from prison after DNA evidence linked another man to the crime. "It's been a long time coming but this is the first day of the rest of my life," he told The Mirror. Mr Malkinson was found guilty in 2004 of raping a woman in Greater Manchester and only had his conviction quashed last month at the Court of Appeal. The law says that someone falsely punished should be financially compensated for the financial harm they have suffered. So if he could have earned, say, 20k per year if he was on the outside, he would get 17x 20k, plus compensation for emotional harm. But since he would have had to pay for food and rent/mortgage anyway if he had not been incarcerated, that much is deducted from his financial package. That is just bull**** IMO, he had his freedom taken away. He had all those years stolen from him, he deserves compensation. To DARE charge him his room and board is just beyond ridiculous.
