Water police were called to the Foreshore Road Boat Ramp at Botany after reports of the accident on the water off Cape Banks at La Perouse at 6am on Saturday.

Two men were in the boat at the time of the collision, one man, aged 61, was pulled unconscious from the water but was unable to be revived by emergency services.

The second man and skipper of the boat, 53-year-old Darren Curmi, was taken to St George Hospital where he remains in a stable condition.

"If you are on the water you need to be 100 metres away from an adult whale, and 300 if that whale has a calf.

"The whales aren’t there to harm anyone, but those interactions can happen."
