Bombshell immunity filing details Trump's alleged 'increasingly desperate' bid to overturn 2020 elec

Special counsel Jack Smith has outlined new details of former President Donald Trump and his allies' sweeping and "increasingly desperate" efforts to overturn his 2020 election loss, in a blockbuster court filing Wednesday aimed at defending Smith's prosecution of Trump following the Supreme Court's July immunity ruling.

Trump intentionally lied to the public, state election officials, and his own vice president in an effort to cling to power after losing the election, while privately describing some of the claims of election fraud as "crazy," prosecutors alleged in the 165-page filing.

"When the defendant lost the 2020 presidential election, he resorted to crimes to try to stay in office," the filing said. "With private co-conspirators, the defendant launched a series of increasingly desperate plans to overturn the legitimate election results in seven states that he had lost."

The defendant asserts that he is immune from prosecution for his criminal scheme to overturn the 2020 presidential election because, he claims, it entailed official conduct. Not so.

Although the defendant was the incumbent President during the charged conspiracies, his scheme was fundamentally a private one.

Working with a team of private co-conspirators, the defendant acted as a candidate when he pursued multiple criminal means to disrupt, through fraud and deceit, the government function by which votes are collected and counted—a function in which the defendant, as President, had no official role.

In Trump v. United States, 144 S. Ct. 2312 (2024), the Supreme Court held that presidents are immune from prosecution for certain official conduct—including the defendant’s use of the Justice Department in furtherance of his scheme, as was alleged in the original indictment—and remanded to this Court to determine whether the remaining allegations against the defendant are immunized.

The answer to that question is no.

This motion provides a comprehensive account of the defendant’s private criminal conduct; sets forth the legal framework created by Trump for resolving immunity claims; applies that framework to establish that none of the defendant’s charged conduct is immunized because it either was unofficial or any presumptive immunity is rebutted; and requests the relief the Government seeks, which is, at bottom, this: that the Court determine that the defendant must stand trial for his private crimes as would any other citizen.

I think they are putting more of this out there now , one reason , because people have a right to know better who it is they might be voting for. I believe there is a lot more evidence to be seen that could really implicate him and his group and expose them and show the people what all really happened and was involved , and if this does not move forward , a lot of it may not come to the fore to be seen. Canon and the SCOTUS really stalled this thing to this point , probably was the whole idea from the start, to stall it , see if he can get elected , then QUASH the whole **** before anyone can really see.

See Trump falls back on his same old witch hunt and weaponizing routines , but all it really does is expose him and what they tried to hide. As far as i understand it , there really is no actual 60 day rule. 

“For 60 days prior to an election, the department of injustice is supposed to do absolutely nothing that would taint or interfere with a case,” Trump wrote on TruthSocial. “They disobeyed their own rule in favor of complete and total election interference. I did nothing wrong, they did! The case is a scam, just like all of the others, including the documents case, which was dismissed!”

Trump’s comments Tuesday refer to the “60-day rule,” the DOJ’s practice of avoiding major legal announcements just before the election. That rule was thrust into the forefront when the FBI held a press conference about Hillary Clinton’s emails before the 2016 election.

“Democrats are Weaponizing the Justice Department against me because they know I am WINNING, and they are desperate to prop up their failing Candidate, Kamala Harris,” Trump said. “The DOJ pushed out this latest ‘hit job’ today because JD Vance humiliated Tim Walz last night in the Debate. The DOJ has become nothing more than an extension of Joe’s, and now Kamala’s, Campaign. This is egregious PROSECUTORIAL MISCONDUCT, and should not have been released right before the Election. The Democrat Party is turning America into a Third World Country that tries to censor, harass, and intimidate their Political Opponents.”

And when the FBI reopened the case about Hilary's emails just days before the 2016 election , what did trump do and say? Did he praise it? 

“What happened today, starting with the FBI, maybe the system will become a little less rigged. Beautiful,” the Republican nominee, who has repeatedly questioned what he deems a “rigged system” against him, said Friday night. It was the third and final rally of a day he argued has breathed new life into his struggling campaign.

He argued his campaign is “really moving” in light of what he termed a “disaster” for Clinton’s campaign and then the billionaire showman even capped off the outdoors rally on a riverbank here with a flashy fireworks display.

“The FBI would not have reopened this case at this time unless it were a most egregious offense,” Trump argued, even though the FBI has not said it is formally reopening the investigation into Clinton’s email server. “I’ve had a lot of words about the FBI lately, but I give them great credit for having the courage to right this horrible wrong.”

 

If the fireworks shed light on Trump’s mood, his supporters’ ear-shattering shrieks, applause and chants of “Lock her up!” at each of his three rallies when Trump raised the “critical breaking news” left no doubt the FBI’s surprise decision had reinvigorated his biggest fans.

First pouncing on the news at a rally in Manchester, New Hampshire, Trump first expressed hope that the FBI will “right the horrible mistake that they made” and lambasted Clinton as a corrupt candidate, even though no new evidence came to light on Friday.

Details are great but i recall a lot of gop and even the more logical maga reaction to j6 was that its trumps fault.

Well , there may be a lot more that we don't know about that could be released if it went forward. Whether the GOP or MAGA figured it was Trump's fault , look how many have bended the knee and the position Trump is sitting in.

The timeline here was filled out somewhat by the House Jan. 6 committee, but the filing contains even more detail.

It says that around 1:30 p.m., Trump settled into the dining room next to the Oval Office and “spent the afternoon there reviewing Twitter on his phone,” while Fox News played on the TV. It suggests prosecutors have forensic evidence from the activity logs on Trump’s phone to back up that he was “consistently” using his Twitter application.

A footnote says that, before Trump’s tweet attacking Pence, advisers told him that “there’s a riot, and there are people inside the Capitol Building,” as well as “that someone’s gotten into the Capitol.”

The filing goes on to say Trump was alone when he tweeted at 2:24 p.m. that Pence “didn’t have the courage to do what should have been done to protect our Country and our Constitution.” (Rioters at one point chanted for Pence’s hanging, and Pence had been evacuated at 2:13 p.m.)

All of those are crucial to establishing that Trump had reason to believe Pence could be in danger and that he knew things had gotten out of hand, and that he pressed forward with attacking Pence anyway. It also builds on extensive evidence suggesting Trump declined for hours to do something about the violence. He didn’t tell people to go home until 4:17 p.m.

But perhaps the most vivid new detail comes from shortly after Trump’s Pence tweet. It says an aide relayed a phone call to Trump stating that Pence had been taken to a secure location. The aide hoped Trump would do something to help, according to the filing.

Instead, Trump allegedly responded: “So what?”

But the filing adds significant new detail.

 

It says then-Republican National Committee Chairwoman Ronna McDaniel cited to Trump a comment from Michigan state House Speaker Lee Chatfield (R) calling claims about voting machines in Antrim County, Mich., “f---ing nuts.”

It says the leader of the Michigan state Senate, Mike Shirkey (R), told Trump he hadn’t lost because of fraud but because he under-performed other Republicans and lost educated women. It adds that Shirkey “could tell by the defendant’s body language that he was not happy to hear” this.

In a filing full of juicy quotes, perhaps one ties it all together. It’s from Trump himself.

“It doesn’t matter if you won or lost the election,” Trump allegedly told family members and others aboard Marine One. “You still have to fight like hell.”

I don't think what you Americans have now is still a democracy. It looks a lot like socialism.

Idk enough to agree or disagree with you but after my jump into politics 2016 i find our system terribly flawed, so much voting for the lesser of two evils out of choices where neither is fit to hold the highest office, the weird to me popular vote and electoral vote, things like a convicted felon being welcome to run and hold high office and if elected can forgive himself of all wrong doing and get off scott free, Dont get me wrong i dont have answers but wish someone did.

I didn't hear him complaining when Comey released his statement about Hillary.

Anyways, the only reason any of the trials are happening this close to the election is because Trump has been delaying over and over. They'd have been done already if they weren't trying to stall.

If his comes out as it looks it seems pretty damning. It as framed as Trump saying it. Surely that would disqualify him and maybe finally put him in jail.

Never was a democracy. It's supposed to utilise the democratic process.

While often categorized as a democracy, the United States is more accurately defined as a constitutional federal republic.

This filing buries any attempt at defending or denying Trump's actions.
