Woman sues man killed by train

A woman hit by a man's body after he was struck by a train is suing the victim over her injuries.
In 2008 Hiroyuki Joho was struck by a train and killed after trying to cross the railway lines during heavy rain, his body was flung upwards by the force of the accident and struck Gayane Zokhrabov, knocking her to the ground and breaking her arm and leg. "If you do something as stupid as this guy did, you have to be responsible for what comes from it," said the judge who handled the case.
Calling it a "tragically bizarre" case, an Illinois appeals court has ruled that a man killed by a train while crossing the tracks at a Chicago Metra station can be held responsible after part of his body struck and injured a bystander.

Isnt that what most are doing on here? Many assuming she is poor with no money to pay for her medial bills? Someone suggested she could be homeless and yet ironically can afford to fork out for lawyers? If you read the thread, you will find most people making up assumptions And who is to say those on here are all parents? I have looked at it one way, you and a few others have looked at the other side.. what have we got? two one sided sets of views... Maybe you should go back and read through the thread again. I see a lot of what IF's... Maybe some lawyers will not require much money.... BUT see what oversword has suggested is only a what IF ... We do not know for sure what she is paying for..we can just post up what IFs and assume she could be paying this and that.. If you want to talk legal responsibility, it would be his closest living relative, which would be his parents...unless he was married. Well, to be fair, as I understand, and I have taken over an estate in the past, the only way the parents would really be dealing with ANYthing financially is if they spent some or all of the value of the estate and THEN a financial sum out of the estate was granted to her. Otherwise, if needed, it would just be removed before they really got involved much. We do not know for sure what she is paying for..we can just post up what IFs and assume she could be payin... I'm not arguing that it's not still a "what if". But the area I live in is absolutely littered with accident lawyers, and we're much smaller than Chicago. Watch TV for ten minutes and you're almost guaranteed to see an accident lawyer commercial. That being said, I don't know of a single accident lawyer in this area that doesn't offer a "if we don't win the case we don't charge you" rate. The no win no fee claims.. Those TV commercials are all over the TV here too.. I mean you cannot turn on the TV without seeing - Injury lawyers 4 U .. and their catchy slogans.. ...Can't help but wonder what ... [More]

Well, to be fair, as I understand, and I have taken over an estate in the past, the only way the parents would really be dealing with ANYthing financially is if they spent some or all of the value of the estate and THEN a financial sum out of the estate was granted to her. Otherwise, if needed, it would just be removed before they really got involved much. The executor is responsible to pay any outstanding debts before claiming or dividing up the estate among the heirs. This would not be considered an outstanding debt and could tie up any money or property until the matter is settled.

Debts and expenses resulting from the death are to be covered first. No finances involved should be considered belonging to the parents until that has been settled in its entirety. As I said the main issue would be if her claims resulted in expenses being paid to her AFTER everything had seemingly been taken care of.
