Florida man injured by exploding toilet in branch of Dunkin' Donuts

If you think you are having a bad day, spare a thought for this guy...
According to reports, Paul Kerouac had been in the men's room of a Florida branch of Dunkin' Donuts back in 2022 when, out of nowhere, one of the toilets exploded right next to him.
Shocked, drenched in toilet water and covered from head to toe in debris and human waste, the unfortunate man staggered out of the toilets in an attempt to find the branch manager.
Legal papers later filed against the company noted that the manager told him that they had been aware of problems with that particular toilet but seemingly hadn't done anything about it.
Kerouac is now seeking $100,000 in damages having suffered "severe and long term injuries" which left him requiring mental health care and counseling.
"As a direct result of (this Dunkin' location's) breach and/or multiple breaches of its duties and obligations to (Mr Kerouac), who was lawfully on (the store's) premises, (Mr Kerouac) unwittingly became the victim of the exploding toilet and of the aftermath which followed, and sustained damages, including long term injuries and emotional and mental distress," his counsel wrote.
Exactly what sort of technical fault could cause a toilet to literally explode remains unclear, but as it stands, it doesn't sound like Dunkin' Donuts has a leg to stand on, legally speaking.
The lawsuit remains ongoing.
